Rent Check Bounced? Prime Property Management can help

What to Do When a Tenant’s Rent Cheque Bounces: A Guide for Southern California Landlords

As a landlord in Southern California, you rely on rent payments to cover your mortgage, maintenance, and other costs. But what if a tenant's rent Cheque bounces? If not treated carefully, it not only annoys but may also cause legal problems and cash flow difficulties.

We have helped landlords throughout communities including Chino, Corona, Eastvale, Anaheim, and others at Prime Property Management to deal with problems like these. Here's a straightforward, step-by-step guide for legally and wisely managing a bounced Cheque.

1. Double-Cheque the Situation

Occasionally, it could not be the tenants' fault. Banks could make mistakes or the problem could be brief. Cheque with your bank to be sure the Cheque bounced back because there wasn't enough money in the account (NSF). Next, gently let your tenant know about the returned Cheque and let them explain.

Tip: Always write (email or text) to have a record.

2. Understand the Conditions of Your Lease

A rent contract should include a clause that includes the provision of bounced Cheques and the renter's responsibility to fix any NSF expenses.

According to California Civil Code 1719, a service fee for a returned Cheque is permitted:

  • Up to $25 for the first returned Cheque,

  • Up to $35 for any additional bounced Cheques.

  • Make sure this is clearly mentioned in your lease to avoid disputes later.

3. Seek an Alternative Payment Method

Don't immediately accept another Cheque if one bounces. Ask instead for a more safer kind of payment, like a money order, cashier's Cheque, or an internet transfer.

This not only guarantees you get paid, but also helps you avoid another returned Cheque.

4.  Send a Formal Notice If Payment Isn’t Received

Should the tenant neglect to reply or neglect to pay within a fair period, legal action could be necessary. In California, a three-day notice to pay rent or quit offers the tenant three working days to pay the rent (plus any costs) or leave the house.

This is the first legitimate move to eviction; it has to be perfect. To guarantee correct delivery and language, it is advisable to talk with a property manager or lawyer.

5. Avoid Problems Down the Road

It might be time to think about switching the payment method permanently or even rethinking their lease when it comes up for renewal if the same tenants Cheques bounce several times. Prime Property promotes safe, electronic rent payments to lower delays and hazards.

Concluding Remarks

By remaining calm, following the law, and engaging in frequent communication with your tenant, you can address the issue quickly and respectfully. Having a competent property management team could be the key to overcoming tough payment obstacles, especially when dealing with complex clients.

Prime Property Management will lead you every step of the way if you need help controlling your rental or creating solid lease terms.
